From Summit to Plummet : A moment of Introspection.

From Summit to Plummet

It was a proud moment for the nation (the nation here being taken to mean those who knew about it and gave a hoot) when one of our own got to interview the President Of The United States (hereinafter POTUS) at the US Africa summit . It was a proud moment because Obama  is undoubtedly the most powerful man on earth and most probably will be until his demise or if Jesus returns before the end of his second term. It was wonderful seeing the 21 year old son of a High School headmaster , Mr T Chingonzoh get to have a one on one with POTUS. These moments fill one with pride as we know for sure we had an audience on a global scale to see just how educated, bold and courageous we as a nation are.

I was thrilled at the prospect of having Obama answer some questions from a young Zimbabwean  nobody,  who ultimately can relate to the struggles that the Zimbabwean youth face daily and can articulate them on our behalf. I had hope that Obama would answer why ,  as a semi -African he seemingly has done little to empower the impoverished African masses. I prayed Obama would be made to see that the power he has in his hands can change millions of lives in Africa and most of all, I really hoped he would listen to a small for voice from a small Southern African state and be made answerable for his action and or inaction in helping alleviate the mounting economic and health  problems in Africa.

Immediately as the interview began  and  Chingonzoh asked about the illegal targeted sanctions or restrictive measures or what you will imposed by America against Zimbabwe, I found myself asking a  small, seemingly unimportant question  as to the meaning of it all… by the end of the interview I no longer felt the glowing amber and warmth of this glorious historical occasion . In fact, it seemed to me that I had watched some sort of façade or caricature .I felt the way I usually do when I have just been duped, and tricked, a feeling of rising bile in the system…..a feeling strikingly similar to the way I felt  when my High School sweet heart cheated on me with some rascal  because I did not have a car and he did (as a side bar the guy she cheated on me with and left with drove a bloody battered rusting yellow Datsun cabbie…the epitome of utter betrayal and deception). At the end of the interview, my attitude toward Obama and what now looked like a well-orchestrated theater production,  went from summit to plummet.

The first question I  asked  is why;  when the President of Zimbabwe was not invited  to this 'important' gathering was young Chingonzoh asked to give this interview ahead of a host of seemingly more suited candidates. With all due respect to Chingonzoh, he is no journalist , was visibly shaken at the prospect of asking Obama a question or two (to the extent that he forgot to introduce himself!) and above all, his country was not even allowed to attend this summit and there were a host of nations to choose from. So why him? I will proffer an answer with minute historical reference :

The dispute between Zimbabwe and the United States stems from what America describes, as Obama put it himself;  Zimbabwe’s rampant abuse of Human Rights. These Human Rights abuses , alleged or actual, lead the US to place targeted sanctions against individuals believed to be the perpetrators of these abuses. America says its’ problem with Zimbabwe also stems from alleged theft of elections and the breakdown of democracy in this country. I will not venture to comment. I merely provide context. Zimbabwe however argues that the bilateral dispute is as a result of the Wests anger at Zimbabwe reclaiming its land from the white minority and moreover because the ruling party , Zanu pf, continually annihilates its ‘puppet agency’
, the MDC , in “free and fair democratic” elections. The Zimbabwean government believes America is a vile evil state bent on exploiting the countries resources and  has  continually interfered in the affairs of a sovereign nation via a perpetuated  regime change agenda meant to turn Zimbabwe into a province of America . Again I will not comment. But one can basically understand that there is an acrimonious dispute.

What does this have to do with an economic summit intended to help foster bilateral business relations between Africa and the United States is the question…. It appears to me as if this summit was used by America to throw another jab at Zimbabwe in this long winding dispute.  By choosing a young Zimbabwean to interview Obama at a summit Zimbabwe itself was not invited to was a very shrewd way by the US of telling Zimbabwe that it loves Zimbabweans , but just not their elected leaders(NIKUV or no NIKUV).  It was a cunning way of saying ‘of course we want dialogue ,we love you Zimbabweans ,but we only love the youths’ who are no doubt less inclined to share their leaders sovereignty views and liberation ideologies. The same youth that are  more intrigued  by the release of the new ipod and the desire to emulate the desperate house wives kind of life. The same youth that are docile, malleable and more easily distracted and less likely to unmask the true agenda of the Western powers.  Neo-colonisation . In essence ,it was a clear signal that America will do business with Zimbabwe, but only on American terms.

We are in a global community and must try by all means to assimilate into it as a nation and to build relationships that buttress our nations gains yet at the same  time improving the nations livelihood, for  the fact of the matter  is;  Zimbabweans and indeed Africans , face severe economic challenges.

One of the ways Africa can help itself to get help is by engaging the rich and powerful nations in a bid to nurture dialogue ,obtain both foreign direct invest and humanitarian aid . This is hardly a secret. Yet it is clear that no matter where we turn to as Africans  for this aid and investment we are met with ancillary conditions that come along with this help and aid that are totally undesirable and will in the long run hurt Africa more than they will aid it. America has no right to interfere in the running of any sovereign nation, let alone Zimbabwe, we do not even need to venture forward and analyse the perilous consequences that meet countries that are ‘helped’ by America. In the same vein , looking east to countries such as China and India seems to be yielding equally disappointing results. We ask China for help to kick start the economic blueprint Zimasset (which on a sober reading is not a terrible road map), yet a full year after their pledge to do so little has been done by China. This is because the Chinese, like the Americans are after one thing, and one thing only where African nations are concerned , and that is our resources. It often seems as if both these super powers have a genuine concern for the livelihoods of Africans but evidence on the ground certainly does not reveal any unpretentiousness .

If America genuinely wanted trade with Zimbabwe ,would they not put aside issues of a political nature to help the individual Zimbabwean start up a business as the agenda of the summit dictates? Would they not set up a bank in Zimbabwe for example that gives out to loans to a clearly bright, ingenuous and innovative Zimbabwean youth? Is doing that hindered by sanctions or which political party is in power in Zimbabwe or is the wool trying to be delicately pulled over our eyes through a mirage of sweet talk and flattering overtures? At the same time,  if the East was serious about helping Zimbabwe would they be flooding our markets with sub-par goods that pulverise our local industry or would they be setting up factories in Zimbabwe and employing our vast skilled labour? Would the East not have resuscitated our mining industry by injecting  the billions they promised , as an example,  into the revamp of the largest iron ore mine in Africa, Ziscosteel, by now?  If they could do this would we not be praising the influx of Asians into our country as God sent rather than questioning where in the world we found such insensitive devils?  The situation is rather obvious is it not? Any which way we turn we will find a rich powerful nation purporting to be ready , willing and able to help Africa yet on closer inspection the hand they offer in aid contains a barrage of traps and complex ‘what will we benefit clauses’ and ‘do what we say contracts’ that will ultimately result in the theft of our identity , resources and freedoms. So . What is the solution?

A wise man who is since long dead once said that a “patriot is always ready to defend his country against his  government”

The above is apt, because however we look at it the problems facing Africa are governance issues. They are corruption issues. They are party patronage issues. They are nepotism issues. They are tribalist , religious and parochial issues. In essence, they are issues we ourselves as Africans have brought upon ourselves and that we can and are compelled to solve.Yet our leaders , in the plush comfort of their residences’  seem to believe if we frolick in the United States of America with our begging bowls at had, the American will return them filled to the brim with US dollars, USAID and all the treats and treasures of the ‘civilised world’ . They appear to have it in their well fed bodies and not so well fed minds that the ghastly plight of the African man , woman and child will be changed by a one week all expenses paid trip to DC to have dinner with POTUS . Our leaders further believe that  if we strategically partner with China they will pour billions into our economies and walk away happy that they have helped the poor African countries survive. The reality of the issue however is: whoever we as Africans turn to wants something in return. Not one of either America or China is attempting to invest or do business with Africa for the benefit of the African, they have their own constituents and their policy is always to please their own before they please others.  Our leaders surely must see this.  If they do not then it our duty as citizens of this continent to point it out, to demand reform ,to demand a government that works for its people first , and then the needs of the super powers to have their ego’s stroked after.  If we continually allow our governments to be corrupt then we will always be see them fly out of our countries at our expense to sign useless bilateral accords that never improve the lives of Africans one bit; rather than see them focus  their attention on providing basic humane standards of living for the people they lead.

We need to identify our problems, our real problems and work towards solving them. We often confuse a call for action with a call for revolution, yet revolution is not essentially what we require. Kwame Nkrumah is dead. The revolution is dead. The time has come for EVOLUTION . We require a move away from apathy and despondency or in simpler terms, we need to get off our behinds and demands the standards of life we deserve from our leaders. We need to hold our leaders accountable for their actions and stop accepting rhetoric, pacification and the threat of brutality as legitimate excuse for an inept governance.  We need to stop telling our leaders that they are entitled to rule us because once upon a time they did something great for the nation or their father did something great or their cousin or next door neighbour  or long lost goat herder did, and start demanding a government that works towards the upliftment  of the African. It really does not matter what a leader calls himself or where he comes from, whether he supports MDC or Zanu pf,  speaks Xhosa or Shona, is a descendant of Shaka or the great chief of the Kikuyu tribes. A leader must be prepared to lead one and all of his people. If a leader of a nation is a leader for a specific race , tribe or religion then fuck him, he is no leader at all.

In conclusion, as Zimbabweans we need to take a look at ourselves and decide whether this is the life we really want. We have to ask ourselves what future we desire. We have to demand that which we know to richly deserve.  As Africans we truly need to wake up from this dream that some angel from the East or West will come down in a cloud of fire and lightning and solve our own problems for us. We need to stop having wet dreams about  FDI and aid from countries that owe us no loyalty nor grant us any. If we stay in our current state of delusion we will wake up  one day to find that which we value and treasure most gone; loaded into a yellow Datsun truck and driven away before our very eyes and we will be left feeling used, abused and terribly betrayed. We have to come together as Africans , kubatana  as we say in shona.

If only Africans could unite we would stand on both feet as giants and not continually scamper to the big powers with our rags and metal begging plates, like rats, clambering to get a crumb from the table upon which gluttons have feasted. We must  remember  to never forget, especially  whenever  America or China offer us a silver spoon or a chair at their dinner table, that they do not need us nor value us much as equals or people, they just want our resources and will say and do whatever it takes to get them. It is our duty to be vigilant enough to come together to stop that. So to put it more brusquely and in the words of one of the greatest modern day  philosophers of all time , Mr Aubrey Graham, when it comes to summonses to summits, whether we attend or not,  we need to remember  “ these fuckers never loved us.” Remember!

Mathonsi J Judgment

CITY LINK COACHES (PRIVATE) LIMITED
Versus
THE SHERRIFF
And
CROCO PROPERTIES (PRIVATE) LIMITED
HIGH COURT OF ZIMBABE
MATHONSI J
HARARE,14 May and 21 May 2014

Opposed application

J. Makarichi,  for the applicant
Ms E. Shumba,  for the respondent
MATHONSI J: Just how a legal practitioner, who is an officer of this court and is required to assist the court in dispensing justice can file an application such as the present, which is completely devoid of merit, fail to file heads of argument and when he is served with a notice of set down for the hearing of the application exactly a month before the set down date, fails to do anything only to file a notice of renunciation of agency a day before the set date, is one of those mysteries of this profession we will never solve. It is difficult to comprehend how such a professional is able to find sleep at night and return to his office the following day expecting the courts to take him seriously.
In Hughber Petroleum (Pvt) ltd and Another  v Nyambuya and Anor  HH 78/14  I bemoaned the egregious departures from proper professional behaviour by legal practitioners which is now the order of the day in this jurisdiction. It would seem that we are not moving anywhere in the direction of holding legal practitioners down to proper behaviour as some still regard themselves as vehicles for abuse of court processes in assisting litigants intent on delaying the enforcement of just claims. There can be no other explanation for the filing of this application and then the hasty retreat of the legal practitioner at the last minute leaving the applicant to his devices ,other than that it was meant to buy time.
On 8 July the Sheriff for Zimbabwe served summons in HC 5191/13 , a matter in which the respondent sued the applicant for payment of US$ 76 288-27 in arrear rentals and operating costs due in terms of lease agreements entered into between the parties, upon the applicant through the medium of Mrs Green “ who accepted service on behalf of the defendant as her  receptionist.”  Instead of entering appearance, the applicant promptly vacated the premises and then wrote to the respondent through its Chief Executive Officer, J Makarichi, on 15 July 2013 in the following;
REF: TERMINATION  OF LEASE FOR 2ND FLOOR BB HOUSE
We advise that we vacated the offices on the second floor of BB House. We move (sic) out during the weekend of 13th and  14th July 2013.
We have been facing operational challenges due to low business volumes and we had no choice but to restructure and scale down our operations. The rentals had also become quite high for us and we had to seek cheaper accommodation out of the CBD.
We would like to thank you for your patience and understanding of our situation during our stay at BB house. We are now making concerted efforts to settle our rental arrears with you. We will be advising you on our payment plan proposal once we have settled in at our new place. We shall send one of our staff members to do the hand-over-take-over of the offices and return the keys.
Yours faithfully
            J.Makarichi
Chief Executive Officer.”
The respondent moved for default judgment which was granted on 4 September 2013 and on 16 October 2013 the Sheriff served a writ of execution against property upon “Mr Makarichi” but having failed to identify attachable property belonging to the applicant , the Sheriff returned a nulla bona. This application for recission of judgement was then filed on 24 October 2013.
In his founding affidavit, Jecksen Makarichi, the applicant’s director, stated that although the summons was served upon Mrs Green on 8 July 2013, she had no authority to accept any process of the court on behalf of the applicant and that process was never forwarded to the applicant’s officers. Had the summons been brought to the attention of the applicant, appearance to defend would have been entered. He protested that the applicant was not in wilful default. A supporting affidavit of Louise Green was also attached in which she states :-
“I, Louise Green , do herby make oath and state that:
1.      I am not a party to this application and the facts herein understated are to the best of my knowledge and belief true and correct.
2.      I confirm that I was served with what I am made to believe to have been a copy of summons and declaration in this matter by the sheriff. I still retain that documents (sic) in my possession for I did not know what to do with them.
3.      I can confirm that none of the officers of this company were made aware of these summons to the present date. That is all I wish to say.”
This, coming from a receptionist of a company manning the front office who had, as illustrated by her signature and identity number acknowledging receipt of a letter addressed to the applicant on 17 October 2012 by the respondent, received other official documents on behalf of the applicant ,is a trifle. Green does not say why she did not hand over the summons to her employers as she was expected to do as a receptionist. She does not explain why she “still retains” the summons not meant for herself.
On the applicant’s defence to the claim Makarichi began by stating that there is no privity of contract between the parties because the lease agreements were concluded between the respondent and  “City Link” as opposed to “City Link Coaches (Pvt) Ltd”. As “City link” is not a legal persona it cannot contract in law. It is however, common cause that ‘City Link” is the applicant’s trading name but in the summons the applicant was correctly cited by its registered name. Nothing more really needs to be said about this issue which is kindergarten.
Makarichi also questioned the validity of the second lease agreement relating to 2nd floor BB House because, although it has a heading citing the parties correctly , clause 2 purports that the agreement is entered with J Makarichi personally. The import of the agreement does not change and again nothing  more has to be said about this shouting in the wilderness.
He went on to say that the applicant was not liable for operating costs even though clause 3 of the leases make it clear that the tenant is liable for operating costs and that these shall be fixed monthly by the landlord.
The application is opposed by the respondent on the basis that not only was the applicant in wilful default in its failure to enter appearance to defend, it having admitted liability throughout, it possesses no conceivable earthly defence to the respondent’s claim. I agree.
Although the applicant made a mess of the citation of the rules in terms of which this application was made, claiming it was made in terms of “: para (a) of sub rule (1) of r 226 as read with Order 9 r 7 of the High Court Rules,” there can be no doubt that this is a r 63 application. That rule allows the court to rescind a judgment given in default if satisfied that there is good and sufficient cause to do so. In other words the applicant must set out good and sufficient cause for the judgment to be rescinded.
In  Roland and Anor v McDonnell 1986 (2) ZLR 216 (S) at 226 good and sufficient cause was interpreted in the following :-
“In coming to a final decision one has to ask whether the defendant has shown        ‘good and sufficient cause’ within the meaning of r 63 of the High Court Rules. Did the court a quo  take into account:-
(a)    The defendant’s explanation of his default ,
(b)   The bona fides of the application to rescind the judgement , and
(c)    The bona fides of the applicant’s defence on the merits of the case, and and did the court normally consider these matters in conjunction with each other and cumulatively?
See also Georgias and Anor v Standard Charted Finance Zimbabwe Ltd 1998 (2) 488 (S): Stockill  v  Griffiths 1992 (1) ZLR (S) 173 D-F.
The explanation tendered by the applicant for its failure to act on the summons is that its receptionist accepted the summons when she had no authority to do so and kept the summons to herself until the present day. Surely that is taking the court for granted. Rule 39 0f the High Court Rules provides for the manner of service of process and in terms of that rule service on a body corporate should be by delivering to a responsible person at the place of business or registered office. Not only is a receptionist a responsible person in respect of a body corporate , she also accepted the process. To my mind this was proper service.
In addition to that , the applicant responded to the summons by vacating the premises stating that it could no longer afford to pay the rental. It also pointed out that it would soon provide a payment plan. Of course it never did.
The applicant does not begin to present a defence. It cannot ,especially after admitting liability. While in the founding affidavit , the applicant attacked the claim for operating costs even when those are provided for in clause 3 of the 2 lease agreements , at the hearing of the matter, Mr Makarichi conceded liability for those costs but maintained that they were excessive. He admitted that there were rent arrears. The applicant agreed to let the respondent fix the operating costs monthly. It is bound by the contract which it entered into freely and with its eyes open. It is not for the court to make a contract for the parties but to observe and protect the sanctity of such contract: Delta Operations (Pvt) Ltd v  Origen Corp (Pvt)Ltd  2007 (2) ZLR 81 (S)86 F-G.
Having read the foregoing it boggles the mind that Mr Chinyama agreed to file the application for rescission of judgement. It should have been apparent to him that there was no merit in such misadventure. His conduct subsequent to the filing of the application is consistent with someone who was aware of that reality and merely filed an application to enable the applicant to gain an unfair advantage over the respondent. He did not bother to prosecute the application. Even after being served with the respondents’ heads of argument on 27 January 2014 he did not bother to file his heads of argument until he was barred. As already stated he beat a hasty retreat at the eleventh hour without the slightest hint of irony. This is unacceptable conduct on the part of an officer of this court.
I conclude therefore that this application is devoid of merit. Accordingly I make the following order, that
1.      The application is hereby dismissed
2.      The applicant shall bear the costs of suit on a legal practitioner client scale.

Rooftop Feminism : Constructed and Deconstructed

It has been a while since I have put my thoughts in more than 140 characters and it has been a woefully long time still since I have articulated topical issues with objectivity and the intent to educate rather than to fuel controversy. It is against this backdrop that I am pleased to return to you the thoughts of a complex mind, fighting a lost cause , given via a wandering  voice that only wishes  to remind us all about the golden rule to  life: that life like love is a two way thing, reciprocation is key.

Rooftop Feminism : Constructed and Deconstructed.
I am a feminist.
I believe that women ought to be treated equally,
I believe that the rights that accrue to women are the same that accrue to men and should be protected and enforced correspondingly.
I believe feminism is a mixture of numerous theories of varying origin that cannot always be categorised or distinguished,
And I believe that not all forms of feminism are universally applicable in universally diverse circumstances.
I believe in feminism.

Rooftop feminism is a term used to describe  a brand of separatist feminism .The term rooftop has been adopted as this type of feminist  often seems detached from reality and metaphorically speaking appears to shout drunken messages of hate and contempt at the world below, from an elevated moral standpoint,ie, a rooftop.Rooftop feminism has as its main aim the expansion of the female moral code to include any and all activities that are considered to be within accepted male behaviour. The female moral code is the standard moral value regime female Africans are bound and expected to behave in accordance with. The female moral code was designed ,conceived and is owned by the patriarchy.

Rooftop feminists essentially aim to conquer male dominance by forcing their ideology upon anyone and everyone without negotiation, without compromise and essentially without a plan. The main  proponents of rooftop feminism  are 16 – 40 year old women, their belief In essence is that  to be a feminist is to prove  you do not need a man and can do anything a  man can do, and better. Characteristics of rooftop feminists include, but are not limited to,an entitlement to the feminist movement and a belief that they own feminism, a strong inclination to alcohol and promiscuity, anger management issues, a patent need to deride and push men down  and an aggressive disdain for criticism.

Rooftop feminism by its nature  excludes reasonable cogent measures aimed at uprooting the causes of the existence of these moral codes that oppress women and aims mainly at  making  a lot of hullabaloo about how evil men are and how downtrodden women are, it speaks nothing about how to deal with the real problem, which is an entrenched patriarchy.
Rooftop feminism places the utmost importance on freedom and liberty of the woman, yet confuses this superficial liberty with achievement in attaining the feminist goals. In as much as liberty is an essential ingredient for the attainment of the feminist goal, Liberty itself  is not the ultimate goal of feminism. The rooftop feminist associates the  ability of a woman to maraud the streets at night  drinking and smoking as an advancement in  the feminist cause in Africa. Although there is nothing in these activities that changes societal perception of women or enhances the chance of society accepting women as equals or empowers them to be afforded equal employment opportunities or protection of  their sexual rights, the rooftop feminists places these 'freedoms' ahead of common sense and convention. Feminism has many forms, but the efficacy of Rooftop feminism in an entrenched cultural society is more than questionable.

Rooftop feminism in its entirety does not award the African female any new rights  or any real power  nor does it postulate reforms, lobby for policy change nor does it  advocate for the education of  society on the problems that patriarchy brings. The rooftop feminist opts rather to devise radical ways of expressing their perceived freedom such as renouncing perceived female obligations and duties such as home making, marriage and cooking and adopting an aggressive , pseudo – enlightened, prima facie male attitude . They go out ,not to say  this is intrinsically evil, but do so more as an act of defiance and like their male counterpart ,they behave promiscuously ,rowdily and in an unruly fashion, with the reasoning simply being, that if a man is not questioned much for any such behaviour, then a woman should never be questioned too. They believe in the power of silly meaningless mantras like ‘pussy power’ ,which unfortunately are just that, mantras  with no real meaning. The point they attempt to make ,objectively speaking maybe a  fair point…it  is, however  always blurred under a haze of cigarette smoke…

The problem that arises for the Rooftop feminist in Africa,  is that society, this male dominated society judges the  rooftop feminist, and the  verdict  usually given is that she is crazy. Based on the expected behavioural codes that the patriarchal system has designed for  women, the behaviour and general attitude of the  rooftop feminist is simply a crazy one. The easiest example to show societal reaction to the rooftop feminist is where marriage is concerned.

In the event that a rooftop feminist is married to an African man, they are expected by both sets of families and the society in general   to conform to the established moral guidelines they are given.  To not conform is to declare oneself a social leper. The traditional African marriage has more requirements than a nuclear launch sequence and is so manifestly oppressive to the African woman that it becomes untenable for a rooftop feminist to aspire to be in one. I will not elaborate in this treatise on the oppressive nature of the African marriage policy, it is a dogs breakfast… In  an attempt by the feminist to avoid the ills of traditional marriage the rooftop feminist opts to do away with marriage and proudly proclaims that they are independent, single and so happy to remain that way, whether this is in fact or in fantasy.

Unfortunately however, society refuses to acknowledge a single woman as a complete woman and again looks at the single feminist as a social leper. In defence of what she believes is correct and right ,the feminist attempts to defend her status ,such defence society then looks at as bitterness and anger, so now the rooftop feminist ,exercising her God given right to be single is labelled a crazy bitter and angry social leper.
There is a third option that rooftop feminists adopt , this is the decision to marry any man except an African man. The rooftop feminists looks to interracial marriage in the not so farfetched hope that  he is from a more enlightened world. This works out until the rooftop feminist  must show  her spouse to her family .More often than not, the declaration from them and society is recurring, she is obviously  crazy and is a social misfit.

The major  problem that rooftop feminists have is more simple than it is complex however, the problem is not necessarily the message, for it is true in the greater scheme of things that  women can do anything better than a man ,they can drink freely as men do and they can, despite the risk behave just as promiscuously as men do if they so choose and should  be treated and judged the same way men are in all contexts ,the problem  simply stated is the motive of the messenger and the manner in which she is delivering this message.

In an overtly  patriarchal African society that has declared the rooftop feminist as crazy, the approach to take is not one of aggression, screaming and or hurling  insults at the average men and women who clearly  do not understand what an angry under dressed , drunken and half stoned woman  is doing way up there on a rooftop declaring she owns the world. Which world?is the question  that this society,  hypnotised to the core by the doctrines of patriarchy asks. Cuckooland?

The solution, for there is always one, is for the rooftop feminist to come down from her roof without a blazing anger against men, without being armed to the teeth with weapons of reverse sexism  without carrying their elitist conventions and to engage  this male dominated society at a level that it understands.
Feminism in Africa is about changing the societal view from worshipping patriarchy to embracing the fact that men and women  are equal and must both be governed by the  same moral code ,which  does not discriminate against anyone based on their gender. The solution lies not in trying to change the female moral code but rather in attempting  to write a singular code and create a moral value system that respects a woman’s independence from men, that does not shun  a woman if she so decides not to marry nor declare that a woman’s place as strictly in the home.

Rooftop feminists must engage the sexist rather than continually taunt and insult him or her, for the current headlong direct confrontation only increases resistance to the feminist movement.  Male domination is not a  problem that can be replaced and ousted  by a generation of seemingly perpetually angry women for nobody will listen to that, no one will listen until these women act  first  and actively  seek societal reform. Patriarchy ,be it a monstrosity, or a flawed  societal system serves many men and women  and is so deeply entrenched  that merely launching into tirades  about how negative it is will not compel those with dominion over it, nor its beneficiaries to simply yield this power  that patriarchy gives over women. When patriarchy is asked to back off by elements it already perceives as unruly and out of the normal, the answer it simply returns is no.

Rooftop feminists indeed have a loud voice  and perhaps a good message, but they must re-assess  whether their actions and voices are being heard correctly and whether this scream and drunken shouting game is achieving the desired results or perhaps whether a new strategy is  required . There must be a sober minded strategic fight to defeat the vile of  patriarchy. At present, because rooftop feminists have the loudest voices and are the most notorious of feminists out there, the image of feminism as a whole has been soiled, feminism is now derided and considered a dirty immoral protest by whores and sluts that is led by angry , single, desperate women. The feminist message has been lost in translation (and an interpreter is required, not one from South Africa though!) to put right the message that the rooftop feminist  has so wrongly contorted .
There are many women and men, radical and liberal, feminist of all manner and description who have their feet firmly on the ground and are changing societal view and ensuring the better treatment of  women without having to make a distasteful display of themselves. These men and women  suffer the most  from the nuisance of rooftop feminism for instead  of fighting against male dominion ,they  must now fight to defend their views and image against the accusations elaborated above that are now daily thrown against genuine women’s rights activists.

Ultimately, all female feminists ,rooftop or otherwise must accept that feminism is not a realm that belongs exclusively to them, feminism is for everybody  as long as they espouse the Ideal that women and men  should be treated equally, respected in equal terms  and afforded the same rights that accrue to all human  beings. Monopolising feminism will do nothing for feminism. For the feminist struggle to be a success every person must be knowledgeable about it and must participate as they are a part of society and depending on how feminists approach them, can be either a help or a hindrance to the feminist cause. Either way, a separatist feminism is simply  fatal to the cause.
Feminists too must accept criticism of their work, and  they must acknowledge that nothing they do is beyond reproach. They must examine and re-examine themselves constantly before rushing to defend themselves against criticism which at times if accepted ,would lead to greater  acceptance of the feminist movement  and yield much more tangible results. Criticism of feminists is not the evil, feminist policies that lead to hate and criticism perhaps are. Introspection is required of all feminists.

Moreover,  rooftop feminists must get off their  high horses  and desist from their intellectual snobbery riddled  with elitist dribble and repugnant aristocratic jargon that women at grassroots level cannot understand. They must understand that it is virtually pointless to discuss the technicalities and modalities  of neo-liberal feminism and sexuality , pomosexuality and theories of  anti – debunctive  feminism   in their comfortable  middle to upper class apartments and then jump on the roof to  regurgitate  these conceptions, snooty faced and all  and expect the ordinary person to understand whatever the hell they will be talking about. Feminism, if all it costs you is data bundles and megabytes is meaningless, it has to be more than that ,it has to be practical, it has to be your sweat and tears, for  the results will not be achieved through any other way. The time for big words and zero action is past.

Lastly,If you are a feminist or claim to be one thereof, and  your  brand of feminism does not empower or educate the woman that matters, being the woman on the ground, on the street, the one really feeling the weight of an unfair societal system, then, with the greatest respect, get your ass off from that rooftop and get some real work done!

OBAMA:My DAD IS REALLY MAD AT YOU!!

--------------------------------------------------------------------------------------------------------------------- Barack Obama was more than just a Senator from Illinois when he first introduced himself to my father,he was far much more than a candidate in the United States election and so much more than a black man making international news with his gospel of hope and good humanity. To my father, Barack Hussein Obama was an enigma, he was a man greater than the Pope, just short of Jesus Christ and worthy to be considered by my father as a Saint ,a friend and a peer.To be sure,5years ago there was no man in the Southern hemisphere with more love and adoration for Barack than my father.
He was to him a luminary,a visionary, a man to lead the world to greater unity and prosperity.A man who could finally end global warming, close the hole in the ozone layer and bring back the dodo from the dead!Yes,he was my fathers own CHUCK NORRIS!!...Seriously though,to my dad, Barack Obama was a man who could prove that hope, when constant in each other as human beings, could conquer all adversity, all poverty, all evil.

I would watch my father as he watched Obama's speeches at 4 am (CAT) during the campaign period and would see my father smile, nod and shout 'yes we can' and finish some of Obama's statements with enthusiasim and rigour dead in the prime of the most ungodly hours. My mother joked that he appeared to be in love, for he would not go to bed in the early evening, rather he opted to watch 'Hardball' with Chris Mathews until the cows came home, studying Barack, taking him in breathing him absorbing him.And YES!!!My father WAS in #LOVE.He was madly in love with the skinny, eloquent black American 'boy' (as he called him) and simply could not get enough of him.The world seemed in love with Obama too, hence my fathers obsessive affection for Barack did not in the least seem unusual.------------------------------------------------------------------------------------------------->

Sadly however, over the last couple of years I have seen that volcanic and passionate love my father once exuded and espoused for Obama, wither to smokeless ambers and ultimately  extinguish into nothingness...Then,I have seen its metamorphisis, first slowly ,hesitantly into indiferrence...and then contempt and then finally rise again with the same torrent and vehemence, but this time as hate.RAW.GENUINE.HATE.

I really do not know how best to describe the feeling of utter disdain that I see in my fathers eyes now, everytime the name Obama is  mentioned. It is the look of total contempt.(Yet, perhaps with tinges of remorse and truckloads of embarassment at being taken for a ride. That feeling of rising bile you have when the horse you where backing loses or your favorite team slips up)

SO,what went wrong? That is what many would want to know......
.... I cannot pinpoint the exact day that the tide turned against Obama in my fathers eyes, but I am certain it was when his troops swarmed Afghanistan. There began a conflict in my fathers heart. It was a pull out from Iraq, only to redeploy to Afghanistan? That felt like a cheap trick to my father,a slap in the face,a betrayal. How could this man really be doing this to him?He said he would bring the troops home did he not?Now what kind of elevated nonsense was this?????Next came Guantanamo. Then Libya. And inbetween, broken promise after broken promise.

But the final straw was when my dad realised what Obama had done...or rather not done, what the so-called messiah had omitted, his most important duty, not one he had promised to fulfill, but one he was obliged to: *To change American Foreign Policy and Attitude Towards/On Africa*   -A FATHERS FAILIURE TO FEED HIS FAMILY IS A CARDINAL SIN IN AFRICA- and that is what Obama was supposed to be to my dad AND to most Africans-an African Father. But alas,He proved my dad wrong;let him down in the most devastating manner.By letting Africa starve,by ignoring Africa and then remembering it only to bomb it,he displayed he was no freind to Africa, definetly not a brotha or an Oga!And he was certainly no father for Africa.............:( :( :( :( :(:( :( :(

..........Indeed,my father does not like Barack Obama anymore. In his words,Obama is a ''deciever'', a ''snake in the grass'' a man who merely ''flattered to decieve'',a Romeo who wooed and seduced his Juliet, yet ultimately left before the baby was born...perhaps thats why we both now concur, that Romeo must indeed Die! (lol..whats a Batanai Tuwe article without an obvious pun)

So Obama. I wish you well. You will never find another supporter like my father...I guess we are the same you and I.We were both angels in my dads eyes once and he bent over time and again to defend us,yet we invariably screwed him in the behind...I, will ofcourse be forgiven brotha Barack, for I am An African. You on the other hand are condemned to an eternity of vitriol...You are dead in my fathers eyes.
RIP Barack.
